1. Introduction
These Terms of Service ("Terms") govern your access to and use of the services provided by DriverCareClub ("we," "us," or "our"), a registered DBA of DTLA Professional Services, LLC. By accessing our website, using our services, or engaging with our platform, you ("the Driver") agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.
2. Description of Services
DriverCareClub is a coordination and facilitation service that connects Drivers with third-party vehicle repair and maintenance shops ("Service Providers"). Our service is limited to the coordination of these services, which includes scheduling, communication, and payment processing. DriverCareClub does not perform any vehicle repair, maintenance, or diagnostic services ourselves. We are not a repair shop and do not employ mechanics or technicians. All services are performed by independent, third-party Service Providers.
3. Driver's Responsibilities
3.1. Scheduling: The Driver is responsible for scheduling all repairs and maintenance through the DriverCareClub website at least twenty-four (24) hours in advance of the desired service time. Appointments are subject to the availability of the Service Provider.
3.2. Communication: The Driver is solely responsible for clearly and accurately communicating their vehicle's service needs, issues, and any other relevant information to the Service Provider. DriverCareClub is not responsible for miscommunication or for services performed that were not explicitly requested by the Driver to the Service Provider.
3.3. Payment Prohibition: The Driver may not pay any Service Provider directly for services coordinated through DriverCareClub. All payments must be made directly to DriverCareClub to ensure proper coordination, tracking, and application of our service fees. Any attempt to circumvent this payment process may result in the suspension or termination of your account.
3.4. Prohibition of Representation: The Driver is not an employee, agent, or representative of DriverCareClub. The Driver is expressly prohibited from making any statements, claims, or representations on behalf of DriverCareClub to any third party, including Service Providers.
4. Payment, Fees, and Estimates
4.1. Service Fee: DriverCareClub charges a two percent (2%) service fee on all services coordinated through our platform. This fee is non-negotiable and is used to cover administrative costs, transaction fees, printing, phone communication, wages, and other operational expenses.
4.2. Repair Estimates and Pricing: The total price of a vehicle repair or maintenance service may not be known until the Service Provider conducts an initial assessment and sends an estimate to DriverCareClub. The final cost may also include additional charges from the Service Provider that are beyond our control. The Driver agrees to be responsible for all such charges.
4.3. Diagnostic Fees: The Service Provider may charge a separate fee for diagnostic work. This fee is a separate charge and must be paid by the Driver.
4.4. Pre-Payment Requirement: All approved services must be paid in full by the Driver before any work is commenced by the Service Provider.
4.5. Chargebacks: In the event of a chargeback initiated by the Driver on a payment made to DriverCareClub, the Driver will be responsible for any fees or costs incurred by DriverCareClub as a result of the chargeback, in addition to the original service payment. Your account may also be suspended or terminated.
4.6. Taxes: The Driver is responsible for all applicable taxes on services performed. All taxes will be calculated and determined by the Service Provider and the location where the service was performed.
5. Service Approval and Coordination
5.1. Three-Party Approval: For any service to be performed, there must be an explicit agreement and coordination among three parties: DriverCareClub, the Driver, and the Service Provider. No work should be performed without the mutual consent of all three parties.
6. Limitation of Liability
6.1. Service Performance: The Driver acknowledges that all services are performed by independent Service Providers and not by DriverCareClub. DriverCareClub is not liable for the quality of work, damages, delays, or any other issues that may arise from the performance of services by a Service Provider. Any claims for damages, faulty repairs, or other issues related to the service performed must be directed to the Service Provider directly.
6.2. No Guarantee: DriverCareClub does not guarantee the results of any financial advice, and results may vary.
7. General Terms
7.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
7.2. Changes to Terms: We reserve the right to modify these Terms at any time. We will post the revised Terms on our website, and your continued use of our services after the effective date of any changes constitutes your acceptance of the revised Terms.
